Seven-year-old Donald Coffey Jr. who was shot two days ago after his father stopped or him and his 5-year-old sister to go to the bathroom in a residential area, has died in a Houston, Texas, hospital officials said.

According to reports, Houston couple Sheila and her husband Gale Muhs, both 45, fired at the family hitting Donald in the head after they mistakenly thought the group was trespassing on their property.

Sheriff’s Cpl. Hugh Bishop said the residential area includes dirt road, trees and overgrown brush and it wasn’t uncommon for people to go off-roading there.

He said the couple, who are charged with second-degree felony counts of aggravated assault in the shootings on Thursday and could face murder charges on Monday, has a sign on their property that reads: “Trespassers will be shot.  Survivors will be reshot!!! Smile I will.”

It is believed that Sheila Muhs fired a 12-gauge shotgun once, and then handed it to her husband, who fired it once also.

After the incident, officials said the Muhs’ called 911 and told the dispatcher: “They’re out here tearing up the levee, so I shot them,” a levee, authority said that belongs to the sub-division and was not private property.

Donald Coffey Sr. suffered a pellet wound in his right shoulder and his daughter, Destiny, suffered a wound to the elbow.

The fourth victim, Patrick Cammack, is listed in serious condition in Memorial Hermann-Texas Medical Center, after he was hit  in the head with a bullet.
