A security guard at a Chico’s Tacos restaurant in El Paso, Texas ordered five men to leave the eatery after he saw two of them kissing, and a police officer agreed with their ouster.
On June 26 around 12:30 a.m., Carlos Diaz de Leon called the police after he and his friends were kicked out of the restaurant because two of his friends were kissing.
The men were placing their order at a Chico’s Tacos when two of them kissed on the lips before sitting down.
A security guard who saw the kiss, ordered all five men to leave the establishment.
Although the men and the civil-rights lawyers said the security staff was out of line, police said that a business such as a restaurant could refuse service to anybody at anytime.
De Leon said one of the guards said, “We don’t allow that faggot stuff in our restaurant,” and as they were waiting for the police outside the eatery, the guards directed other anti-gay slurs at them.
When the police arrived, De Leon said, “I went up to the police officer to tell him what was going on, and he didn’t want to hear my side. He wanted to hear the security guard’s side first.”
De Leon said the unnamed officer told them it was illegal for two men or two women to kiss in public, and told the group that they could be cited for homosexual conduct, a law the U.S. Supreme Court ruled unconstitutional in 2003 in Lawrence v. Texas.
A spokesperson for the police described the officer as relatively inexperienced.
El Paso police Detective Carlos Carrillo said, “The security guard received a complaint from some of the customers. Every business has the right to refuse service. They have the right to refuse service to whomever they don’t want there. That’s their prerogative.”

OKAY TEXAS, I GUESS A RACIST RESTAURANT OWNER CAN TELL A BLACK COUPLE TO LEAVE THEIR ESTABLISHMENT BECAUSE THEY DON’T SERVE BLACKS, AND THAT’S PERFECTLY OK WITH YOU, BECAUSE AS CARRILLO SAID, “EVERY BUSINESS HAS THE RIGHT TO REFUSE SERVICE TO WHOMEVER THEY DON’T WANT THERE.”
The inexperience officer did not file a report of the incident and Carrillo said the officer didn’t because he thought the situation was under control.
