Shepard Fairey, 38, a street artist who became famous for his red white and blue “Hope” posters of President Barack Obama, was arrested for tagging property with graffiti.

Last night, police in Boston, Massachusetts, arrested Fairey while he was on his way to the Institute of Contemporary Art, for a kickoff event for his first solo exhibition called “Supply and Demand.”

On January 24, two warrants were issued for his arrest after it was determined that he had tagged properties in two locations with graffiti.

Fairey will be arraigned on the misdemeanor charges on Monday.

Recently, the Associated Press disputed Fairey’s claim to the picture that made the Los Angeles native famous.

Fairey argued back that his use of the photo, which is rightfully owned by the AP, is protected by “fair use,” which allows exceptions to copyright laws based on, among other factors, how much of the original is used, what the new work is used for and how the original is affected by the new work.
