A 42-year-old Long Island, New York, was given two summonses for laughing too loud in his own home.
Disable Robert Schiavelli, who lives with his mother in Rockville Center, said he was issued the summonses on February 12 and 13 after neighbor, Daniel O’Hanian, called 911 to report that his laughter was traveling across the driveway that separates the two homes and into his house.
A lawyer for Schiavelli said his client was charged him with “acting in such a manner as to annoy, disturb, interfere with, obstruct, or be offensive to others.
Schiavelli faces 15 days in jail and a fine of $250 if he is found guilty.
Schiavelli, who says he suffers from neurological impairments which causes him to have seizures, says his neighbor often taunts him about his disability and when that happens, he goes into his house, opens his windows, and laughs very loudly at him.
Schiavelli’s 65-year-old mother said O’Hanian and his wife, Virginia, have been calling her son “retard” for many years.
It is likely that a judge will dismiss the charges when the case goes to court.
What a waste of taxpayers’ dollars!!!
