Authorities in Maryland said no charges will be filed against the driver who struck and killed a 13 year-old boy who was killed when he opened a car door into oncoming traffic to throw up.

Reports say Michael Truluck was in a vehicle that was exiting a parking lot onto a busy road when he became ill shortly after consuming the energy drink Four Loko.

As Truluck opened the car door to throw up he was struck and killed by another vehicle.

It is believed that Truluck, who was an eighth-grader at Parkville Middle School in Baltimore County, was given the drink by an adult who had purchased it at a local liquor store.

During a vigil on Sunday Truluck’s mother, Kris Keys, urged a group of young people to stay away from the drink, which was banned by the manufacturer because of the high number of deaths associated with the drink.

“It is not cool to drink and to get high,” Keys told the group.  “Accidents happen on the best intentions and I’ve lost the only son I’m ever going to have because they wanted to party.”

Authorities said no charges will be filed against the driver of the vehicle that struck the teenager; however, they did not say whether charges will be filed against the adult who purchased the drink.
